এ বার খাস কলকাতাতেই আক্রান্ত হল পুলিশ। এক দিনের ব্যবধানে কর্তব্য পালন করতে গিয়ে শহরে দু’বার আক্রমণের মুখে পড়তে হল তাদের। মঙ্গলবার দুপুরে যাদবপুরের সন্তোষপুরে এবং রবিবার রাতে লেক এলাকার গোবিন্দপুর কলোনিতে এই দু’টি ঘটনায় মোট চার জন পুলিশকর্মী জখম হন। সন্তোষপুরের ঘটনায় পুলিশের উপরে হামলায় নেতৃত্ব দেওয়ার অভিযোগ উঠেছে এক তৃণমূলের কাউন্সিলরের বিরুদ্ধে। অভিযোগ, কর্তব্যরত এক সার্জেন্টের সঙ্গে বচসার জেরে তাঁর উপর চড়াও হন তিনি।
সন্তোষপুরের লেকপল্লিতে ঘটনার সূত্রপাত এক ট্যাক্সিচালককে ‘কেস’ দেওয়াকে কেন্দ্র করে। পুলিশ ও স্থানীয় সূত্রে জানা গিয়েছে, এ দিন দুপুর একটা নাগাদ এক ট্যাক্সিচালক সন্তোষপুরের রাস্তায় নো-পার্কিং জোনে ট্যাক্সি দাঁড় করালে কর্তব্যরত সার্জেন্ট মানবেন্দ্র বিশ্বাস তাঁকে ‘কেস’ দিতে যান। ট্যাক্সিচালক তখন ওই সার্জেন্টকে কোনও ‘কেস’ না দিয়ে ‘স্পট ফাইন’ করার অনুরোধ করেন। অনুরোধ মেনে তাঁকে জরিমানা করেন সার্জেন্ট।
পুলিশের একাংশের অভিযোগ, ওই সময়ে ঘটনাস্থলের কাছেই ছিলেন ১০৩ নম্বর ওয়ার্ডের তৃণমূল কাউন্সিলর সঞ্জয় দাস। ট্যাক্সিচালককে কেস দেওয়া নিয়ে মানবেন্দ্রবাবুর সঙ্গে বচসা বাধে তাঁর। মানবেন্দ্রবাবুর সঙ্গী আর এক সার্জেন্ট সুকান্ত মুহুরি সেই সময়ে মোবাইলে ওই বচসার ছবি তুলতে গেলে সঞ্জয়বাবু ও তাঁর সহযোগীরা মোবাইল কেড়ে নিয়ে তাঁর উপরে চড়াও হন বলে অভিযোগ। তখনই ধাক্কাধাক্কিতে মাটিতে পড়ে যান সুকান্তবাবু। পুলিশ সূত্রে খবর, সুকান্তবাবুকে বাঘা যতীন স্টেট জেনারেল হাসপাতালে নিয়ে যাওয়া হয়। তাঁর বুকে এবং মাথায় চোট লেগেছে বলে চিকিৎসকেরা পুলিশকে জানিয়েছেন। যদিও বিষয়টি নিয়ে ওই দুই সার্জেন্টের কেউই সংবাদমাধ্যমের কাছে মুখ খুলতে রাজি হননি।
পুলিশ সূত্রে জানা গিয়েছে, রাতে সার্ভে পার্ক থানায় ওই কাউন্সিলর এবং তাঁর সহযোগীদের বিরুদ্ধে অভিযোগ দায়ের করেন মানবেন্দ্রবাবু। তার ভিত্তিতে সরকারি কর্মীর কাজে বাধাদান, তাঁর উপরে হামলা চালানো, হুমকি দেওয়া এবং ভয় দেখানোর মামলা রুজু করেছে পুলিশ। রাতে লালবাজারের এক কর্তা বলেন, “ওই সার্জেন্টের অভিযোগের ভিত্তিতে কাউন্সিলরের বিরুদ্ধে মামলা রুজু করা হয়েছে। তদন্তও শুরু হয়েছে।” তবে পুলিশের একটি নির্ভরযোগ্য সূত্রে জানা গিয়েছে, এই ঘটনার কথা প্রথমে চেপে যাওয়া হয়েছিল। ঘটনার ছ’ঘণ্টারও বেশি সময় পরে এ নিয়ে এফআইআর দায়ের করা হয়।
তবে বিষয়টি নিয়ে অভিযুক্ত কাউন্সিলর সঞ্জয়বাবুর সঙ্গে বারবার যোগাযোগের চেষ্টা করা হলেও তাঁর মোবাইল বেজে যায়। এসএমএসেরও জবাব মেলেনি।
অন্য দিকে, রবিবার রাতে কালীপ্রতিমা বিসর্জনের সময়ে বাজি ফাটানো নিয়ে দুই ক্লাবের সংঘর্ষ হয়। তা আটকাতে গিয়ে মার খায় পুলিশ। পুলিশের অভিযোগ, তাদের লক্ষ করে ইট, পাথর, বাজি ছোড়া হয়। এতে জখম হন তিন পুলিশকর্মী। ঘটনাটি ঘটেছে লেক থানার গোবিন্দপুর লেনে।
পুলিশ সূত্রের খবর, ওই রাতে বিসর্জন সেরে এলাকায় ফিরছিলেন স্থানীয় একটি ক্লাবের সদস্যেরা। মাঝরাস্তায় যোধপুর পার্কের একটি ক্লাবের শোভাযাত্রার মুখোমুখি হন তাঁরা। পুলিশ জানায়, যোধপুর পার্কের ওই ক্লাবটির সদস্যেরা অন্য ক্লাবটির সদস্যদের লক্ষ করে বাজি ছোড়ে। এর জেরে দু’পক্ষের সংঘর্ষ শুরু হয়। সংঘর্ষের খবর পেয়ে ঘটনাস্থলে পৌঁছয় লেক থানার চার পুলিশকর্মীর একটি দল। পুলিশ জানিয়েছে, সংঘর্ষ নিয়ন্ত্রণ করতে গেলে পুলিশকে লক্ষ করেও ইট, পাথর, বাজি ছোড়া হয়। ঘটনায় তিন পুলিশকর্মী জখম হন। এই ঘটনায় এখনও কাউকে গ্রেফতার করা যায়নি বলে জানায় পুলিশ।
একই আইন এবং একই অভিযোগ। অথচ, দুই ক্ষেত্রে আইনের পৃথক ফল।
মঙ্গলবার সকালে সার্ভে পার্কে এক তৃণমূল কাউন্সিলরের নেতৃত্বে আক্রান্ত হয়েছিলেন কর্তব্যরত ট্রাফিক সার্জেন্ট। সার্ভে পার্কের ঘটনায় রাতে পুলিশে অভিযোগ দায়ের হলেও বুধবার রাত পর্যন্ত অভিযুক্ত ওই কাউন্সিলরকে গ্রেফতার করেনি পুলিশ। আইনের ভিন্নতা দেখা গেল এই ঘটনার ১১ ঘণ্টা পরে। পুলিশ জানিয়েছে, একই দিনে রাত সাড়ে ১১টা নাগাদ দুই পুলিশকর্মীকে মারধর করেন এক ব্যক্তি। আর এই ঘটনার প্রায় সঙ্গে সঙ্গেই গ্রেফতার করা হয় তাঁকে। ধৃতের নাম নিরঞ্জন চৌধুরী। পুলিশ জানিয়েছে, ঘটনার সময়ে মত্ত অবস্থায় ছিলেন তিনি।
কিন্তু একই ধরনের ঘটনায় ভিন্ন আইন কেন? এই নিয়ে বুধবার যুগ্ম কমিশনার (সদর) রাজীব মিশ্রকে জিজ্ঞাসা করা হলে তিনি বলেন, “ফৌজদারি আইনে সব সময়ে গ্রেফতার বাধ্যতামূলক নয়। ঘটনার পরিস্থিতি বিচার করে গ্রেফতার করা হয়। এই ক্ষেত্রে তদন্ত চলছে।”
স্থানীয় সূত্রে খবর, মঙ্গলবার দুপুর একটা নাগাদ নিয়ম ভাঙার অভিযোগে এক ট্যাক্সিচালককে ‘কেস’ দিতে গিয়ে আক্রান্ত হন পূর্ব যাদবপুর ট্রাফিক গার্ডের এক সার্জেন্ট। সন্তোষপুর এলাকার লেকপল্লিতে ঘটনাটি ঘটে। পুলিশের উপরে আক্রমণের সময়ে ১০৩ নম্বর ওয়ার্ডের তৃণমূল কাউন্সিলর সঞ্জয় দাস নেতৃত্ব দেন বলেও অভিযোগ। পুলিশ সূত্রে জানা গিয়েছে, এই ঘটনায় সার্জেন্ট সুকান্ত মুহুরি জখম হন। তাঁর বাইক ক্ষতিগ্রস্ত হয়। মানবেন্দ্র বিশ্বাস নামে আর এক সার্জেন্টের মোবাইল ফোনটি ভেঙে ফেলারও চেষ্টা করা হয় বলে অভিযোগ। প্রথমে বিষয়টি নিয়ে পুলিশ মহলে কেউ কিছু বলতে না চাইলেও পরে রাতের দিকে তৃণমূল কাউন্সিলর সঞ্জয় দাসের নামে থানায় অভিযোগ দায়ের হয়। অথচ সেই ঘটনায় এখনও অভিযুক্ত কাউন্সিলরকে গ্রেফতার করা হয়নি।
কী ঘটেছে হরিদেবপুরে? পুলিশ জানায়, ওই রাতে নিরঞ্জনবাবু হরিদেবপুর থানার এক কনস্টেবলের সঙ্গে বচসায় জড়িয়ে পড়েন। ঘটনাস্থলে আসেন আরএফএসের কয়েক জন কর্তব্যরত পুলিশকর্মী। মত্ত অবস্থার নিরঞ্জনবাবুর সঙ্গে তাঁরাও বাগবিতণ্ডায় জড়িয়ে পড়েন।
পুলিশ জানিয়েছে, এর পরেই মত্ত ওই ব্যক্তি আচমকা তাঁদের মারধর করতে শুরু করেন। ঘটনায় দুই পুলিশকর্মী অল্পবিস্তর জখম হয়েছেন। পুলিশ জানিয়েছে, ঘটনার পরেই পুলিশকে মারধরের অভিযোগে নিরঞ্জনকে গ্রেফতার করা হয়েছে।
পুলিশ সূত্রের খবর, দু’টি ঘটনাতেই কর্তব্যরত অবস্থায় পুলিশের উপরে হামলায় অভিযুক্তদের বিরুদ্ধে ৩৫৩ ধারায় মামলা রুজু হয়েছে। সঙ্গে রয়েছে হুমকি (৫০৬), ৫০ টাকা মূল্যের বেশি সম্পত্তি ধ্বংস (৪২৭) এবং সমবেত হামলার (৩৪) ধারাগুলি। পুলিশ জানিয়েছে, আইনের অন্য ধারাগুলি জামিনযোগ্য অপরাধ হলেও ৩৫৩ ধারাটি জামিন-অযোগ্য। এই ধারায় অভিযুক্তের দুই বছরের কারাদণ্ড বা অর্থদণ্ড বা দু’টো সাজাই হতে পারে। অথচ অভিযোগ, অভিযুক্ত ওই তৃণমূল কাউন্সিলরকে গ্রেফতার তো দূর অস্ত্, জিজ্ঞাসাবাদ পর্যন্ত করা হয়নি। দুই ক্ষেত্রে দু’রকমের ব্যবস্থা নেওয়ায় প্রশ্ন উঠেছে পুলিশের ভূমিকা নিয়েও। পুলিশের একাংশের বক্তব্য, এ ক্ষেত্রে অভিযুক্ত এক জন তৃণমূল কাউন্সিলর হওয়ার কারণেই এমন ঘটেছে। তাঁকে গ্রেফতার করতে হলে উপরমহল থেকে অনুমতির প্রয়োজন।

The court referred the case to Calcutta High Court for further action, also directed the district police to set up a high-level inquiry committee headed by a DSP against the accused officers.
The Parui police produced an accused, Ali Jinnah, twice before the court and showed him as accused in two different cases and even prayed for his remand.
The accused, a TMC supporter, was first arrested on Tuesday on the basis of an FIR lodged at the Parui PS on the clash between TMC and BJP in Makra village on Monday. The court remanded the accused in police custody for five days along with 10 other accused who were also arrested
The same person was again produced in court by the police on Thursday and was shown as an accused in a suo motu case lodged by the police on the Makra clash and again prayed for his remand
A disgusted chief judicial magistrate of Birbhum, Indranil Chatterjee, summoned the OC to the court and asked him how can he ask for remand of an accused who his already in his remand.
The OC said to court that this was a "mistake" and asked for the court's pardon. The judge observed that a "mistake" is when you write two plus two as six, but if you write two plus two as Shakespeare, then that cannot be called a "mistake", it's an abuse of power.
The disciplinary action on the accused officers was given by the court on Friday after the follow up hearing in this case.

বৃহস্পতিবার বলেছিলেন, ‘মিসইউজ অব পাওয়ার’ অর্থাৎ, ক্ষমতার অপব্যবহার। শুক্রবার আরও কঠোর ভাষায় বললেন, ‘মিসক্যারেজ অব জাস্টিস’ (বিচারের গর্ভপাত)!
বললেন, বীরভূমের মুখ্য বিচারবিভাগীয় ম্যাজিস্ট্রেট বা সিজেএম ইন্দ্রনীল চট্টোপাধ্যায়। শুনলেন, জেলা পুলিশের ডিএসপি (শৃঙ্খলা ও প্রশিক্ষণ) সুমিত চট্টোপাধ্যায়। মাখড়া-কাণ্ডে ধৃত আলি জিন্নাকে নিয়ে পরপর দু’দিন জেলা পুলিশকে এ ভাবেই তুলোধোনা করলেন সিজেএম। পাড়ুই থানার ওসিকে সরিয়ে দেওয়া, তদন্তকারী অফিসারকে মাখড়ার তদন্ত থেকে সরিয়ে দেওয়া-সহ একাধিক সুপারিশও করলেন বিচারক। এমনকী, পুলিশের ‘ভুলে’র সত্যতা খতিয়ে দেখতে ডিএসপি পদমর্যাদার কোনও অফিসারকে দিয়ে তদন্ত করানোর নির্দেশও দিয়েছে আদালত। পাশাপাশি বিচারক জানিয়েছেন, বিষয়টি কলকাতা হাইকোর্টে ‘রেফার’ (গোচরে) করা হচ্ছে। নির্দেশ দিতে গিয়ে বিচারকের মন্তব্য, “যদি আদালত নরম মনোভাব দেখায়, তা হলে মানুষের কাছে ভুল বার্তা যাবে। যে কেউ ভাবতে পারেন, কোনও অন্যায় করে শুধু ‘ভুল হয়ে গিয়েছে’ বলে পার পাওয়া যায়। সেটা ঠিক হবে না। তাই বীরভূমের পুলিশের সুপারের কাছে সুপারিশগুলি করছি।”
এ দিনই গণধর্ষণের এক মামলায় একাধিক বার আদালতের নির্দেশ অমান্য করায় নদিয়ার নাকাশিপাড়ার ওসি রাজা সরকারকে বিচারবিভাগীয় হেফাজতের নির্দেশ দেয় কৃষ্ণনগর আদালত। পরে অবশ্য জামিন পান।
মাখড়া-কাণ্ডে জড়িত অভিযোগে মঙ্গলবার রাতে জিন্নাকে গ্রেফতার করেছিল পাড়ুই থানার ওসি। বুধবার তাকে পুলিশি হেফাজতে রাখতে বলেন সিজেএম। বৃহস্পতিবার ফের জিন্নাকেই গ্রেফতার দেখিয়ে সিজেএমের এজলাসে তুলে হেফাজতের আবেদন জানায় পুলিশ। আর তাতেই ক্ষোভে ফেটে পড়েন বিচারক। ওসি ও অ্যারেস্টিং অফিসারকে এজলাসে ডেকে তীব্র ভর্ৎসনা করেন। পুলিশের দাবি ছিল, ‘ভুল’ করে এই কাণ্ড ঘটেছে। ঘটনার লিখিত ব্যাখ্যা-সমেত শুক্রবার আদালতে পুলিশ সুপার, ওসি এবং তদন্তকারী অফিসারকে হাজির থাকার নির্দেশ দেন বিচারক।
এ দিন বেলা ১১টায় ডিএসপি সুমিতবাবু এজলাসে এসে পৌঁছন। দশ মিনিট পরেই চলে আসেন পাড়ুই থানার ওসি কার্তিকমোহন ঘোষ, জিন্নার অ্যারেস্টিং অফিসার ধ্রুবজ্যোতি দত্ত ও তদন্তকারী অফিসার গোপালচন্দ্র চন্দ্র। বেলা ১১টা ২০ মিনিটে ওঠে মামলা। সুমিতবাবু বিচারককে জানান, মায়ের পারলৌকিক কাজের জন্য এসপি ছুটিতে থাকায় তিনি এসেছেন।
বিচারক (ডিএসপি-র উদ্দেশে): আপনি ঘটনার কথা জানেন তো?
ডিএসপি: আদালতের আদেশনামা পেয়ে জানতে পেরেছি।
বিচারক: পুলিশ রিমান্ডের জন্য ফরোয়ার্ড আপনিই করেছিলেন তো?
ডিএসপি: হ্যাঁ।
বিচারক: আর আগেরটা? (জিন্নাকে হেফাজতে চেয়ে বুধবারের আবেদন)
ডিএসপি: ওটা আমি করিনি।
লিখিত ব্যাখ্যা এনেছেন কি না ওসি-র কাছে জেনে নেন বিচারক। কাঠগড়ায় ওঠেন অ্যারেস্টিং অফিসার ধ্রুবজ্যোতি দত্ত (যিনি বুধবার জিন্নাকে তার বাড়ি থেকেই ধরেছেন বলে দাবি করে বৃহস্পতিবার কোর্টে তুলেছেন)
বিচারক: আমাকে বলুন তো, পুলিশি হেফাজতে থাকা এক জন আসামিকে আপনি দৌড়োদৌড়ি করে ধরলেন কী ভাবে?
আইও: স্যার, মিস্টেক হয়েছে।
বিচারক: অন্য শব্দ বাছুন। আগেও আপনাকে বলেছি, এটা ভুল নয়। (ডিএসপি-র দিকে তাকিয়ে) ঘটনার ভিত্তিতে আপনারা কি কোনও বিভাগীয় পদক্ষেপ করেছেন?
ডিএসপি: স্যার, এসপি সাহেব জানিয়েছেন আদালতে কী হচ্ছে, ছুটি থেকে ফিরে সেই নির্দেশ দেখবেন। আদালত নির্দিষ্ট পদক্ষেপ করার নির্দেশ দিলে উনি ব্যবস্থা নেবেন।
বিচারক: (ওসি-কে) আপনি কী ব্যবস্থা নিয়েছেন?
ওসি: আইও এবং অ্যারেস্টিং অফিসারের বিরুদ্ধে রিপোর্ট দিচ্ছি।
(এর পরেই বিচারক পুলিশের ভুলের ব্যাখ্যা চান)
বিচারক: নিজেদের হেফাজতে থাকা এক ব্যক্তিকে ফের বাড়ি থেকে গ্রেফতার করার কথা বলছিল পুলিশ। সেটার কী ব্যাখ্যা?
সরকারি আইনজীবী: আসলে ওই থানায় আইনশৃঙ্খলার অবনতি হয়েছে। পুলিশকর্মীরা খুব চাপে আছেন। সেই জন্য এমন ভুল হয়ে গিয়েছে।
বিচারক: এটা হয় নাকি! ধরুন, আপনি এখানে রয়েছেন। কেউ যদি বলে আপনাকে মুম্বইয়ে দেখা গিয়েছে, সেটা কি সম্ভব?
সরকারি আইনজীবী: (বিব্রত হয়ে) সত্যিই এর কোনও গ্রহণযোগ্য ব্যাখ্যা নেই।
এর পরেই জিন্নার জামিনের পক্ষে সওয়াল করেন অভিযুক্তের আইনজীবী মলয় মুখোপাধ্যায় (তৃণমূলের জেলা সহ-সভাপতি)। বিচারক চট্টোপাধ্যায় জিন্নাকে ফের তিন দিনের পুলিশি হেফাজতের নির্দেশ দেন। সব শেষে বিচারক পুলিশ সুপারের উদ্দেশে সুপারিশগুলি দেন। কলকাতা হাইকোর্টের অবসরপ্রাপ্ত বিচারপতি ভগবতীপ্রসাদ বন্দ্যোপাধ্যায় বলেন, “পুলিশ আদালতের সঙ্গে প্রতারণা করেছিল। তাই আদালত ঠিকই নির্দেশ দিয়েছে। আদালতের এই এক্তিয়ার রয়েছে।” আইনজীবী বিকাশ ভট্টাচার্যের মত, “আইনের শাসন বজায় রাখতে এই নির্দেশ সঙ্গত।”
এ দিন রাজ্যপাল কেশরীনাথ ত্রিপাঠীর সঙ্গে দেখা করে পাড়ুই-প্রসঙ্গ তোলেন বিরোধী দলনেতা সূর্যকান্ত মিশ্র। তিনি বলেন, “রাজ্যপালকে আমরা বলেছি, আপনার সরকার (যে হেতু আনুষ্ঠানিক ভাবে রাজ্য সরকারকে ‘আমার সরকার’ বলেই উল্লেখ করতে হয় রাজ্যপালকে) প্রায় প্রতি দিন আদালতে ভর্ৎসিত হচ্ছে। প্রশাসনের উপরে সাধারণ মানুষের আর আস্থা নেই। আদালতের কাছে তাঁদের বিচার চাইতে যেতে হচ্ছে এবং আদালতকেও হস্তক্ষেপ করতে হচ্ছে। এটা গণতন্ত্রের পক্ষে বিপজ্জনক।” রাজ্যপালের সঙ্গে সাক্ষাৎ সেরে একই সুরে বিজেপি-র রাজ্য সভাপতি রাহুল সিংহ বলেছেন, “পুলিশের অবস্থা তো আদালতের বক্তব্য থেকেই পরিষ্কার। আর যে স্বরাষ্ট্রমন্ত্রীর নিজের পুলিশের উপরে আস্থা নেই, তিনি স্বরাষ্ট্রমন্ত্রী থাকেন কী করে?”

পুলিশের হেফাজতে থাকা অভিযুক্তকে ফের গ্রেফতার দেখানোর জের। পাড়ুই থানার ওসিকে সরিয়ে দিতে পুলিশ সুপারকে অনুরোধ সিউড়ি আদালতের। সাসপেন্ড করার সুপারিশ এক তদন্তকারী অফিসারকে। গতকালই পাড়ুই থানার ওসিকে তলব করে তিরস্কার করেন বিচারক।
শুনানির শুরুতেই এদিনও পাড়ুই থানা ওসি এবং তদন্তকারী অফিসারকে তীব্র ভর্ত্সনা করেন বিচারক। তিনি বলেন, সামগ্রিক পরিস্থিতি খুব দুর্ভাগ্যজনক. শুধু অভিযুক্তর জন্য নয়, আদালতের জন্যও। এই পরিস্থিতি তৈরি হল পুলিশ অফিসারদের চূড়ান্ত অকর্মণ্যতার জন্য। এই ঘটনা তদন্তকারী অফিসারের চূড়ান্ত স্বৈরাচারী মনোভাবের পরিচয়। সে কাজে সমর্থন ছিল ওসির। এবং একজন ডিএসপি দ্বিতীয় দফার হেফাজত চাওয়ার আবেদন আদালতে পাঠিয়েছেন।
তদন্তকারী অফিসারেরও কড়া সমালোচনা করে বিচারক বলেন, শুধু মন্তব্য করে বা সতর্ক করে ছেড়ে দেওয়াটা সম্ভব নয়। যদি আদালত এক্ষেত্রে কড়া পদক্ষেপ না নেয়, তাহলে ভুল বার্তা যাবে। পরবর্তী সময়ে এধরনের কাজ করে সবাই ‘ভুল হয়ে গিয়েছে’ বলে পার পেয়ে যাবে।
এটা স্পষ্ট, তদন্তকারী অফিসার ধ্রুবজ্যোতি দত্ত আলি জিন্নাকে পাড়ুই থানার পুলিশ লকআপ থেকে বের করে ১৫২ নম্বর মামলার অভিযুক্ত হিসেবে গ্রেফতার দেখিয়ে আদালতে পেশ করেছেন। অথচ আদালতের রেকর্ডে দেখানো হয়, আলি জিন্নাকে বাড়ি থেকে গ্রেফতার করা হয়েছে। তদন্তকারী অফিসার মিথ্যা বিবৃতি দিয়েছেন এবং পুরো ঘটনাক্রমকে ভুলভাবে দেখিয়েছেন। আদালত এই মামলাটি হাইকোর্টের নজরে নিয়ে আসবে। আদালত তদন্তকারী অফিসারকে সরাসরি সাসপেন্ড করার সুপারিশ করছে।
পুলিশ সুপারকে অনুরোধ করছি, এই কথা ভেবে দেখতে, তার পুলিশ বাহিনীকে কোন অফিসাররা কাজ করছেন, এবং তাঁরা আদৌ কাজ করার যোগ্য কিনা।
এরপর পাড়ুই থানার ওসিকে তীব্র ভর্ত্সনা করে বিচারক মন্তব্য করেন, অফিসারের দেওয়া নথিতে অন্ধের মতো সই করেছেন ওসি। সেসময় ওসি ঘুমোচ্ছিলেন কিনা, আমরা বুঝতে পারছি না। আমাদের যথেষ্ট সন্দেহ রয়েছে। যখন তদন্তকারী অফিসার আলি জিন্নাকে লক আপ থেকে বের করছেন, তখনও ওসি বুঝতে পারলেন না কী হচ্ছে! আদালত সুপারিশ করছে, ওসির ভূমিকা খতিয়ে দেখতে পুলিশ সুপার বিভাগীয় তদন্ত করুন। ন্যূনতম ডিএসপি পদমর্যাদার অফিসারকে দিয়ে বিভাগীয় তদন্ত করানো হোক। আদালত পুলিশ সুপারকে অনুরোধ করছে, কার্তিকমোহন ঘোষকে যত দ্রুত সম্ভব ওসির পদ থেকে সরানোর জন্য।
সরকারি আইনজীবীও স্বীকার করে নিয়েছেন, পাড়ুই থানার লকআপে বন্দিদের অতিরিক্ত ভিড়ের জন্য এই ভুল। আদালতের নির্দেশে সরকারি আইনজীবীর সেই মন্তব্যেরও উল্লেখ রয়েছে।
ধৃত আলি জিন্নাকে আগের মামলা অর্থাৎ ১৫৫ নম্বর মামলার তদন্তকারী অফিসারের হাতেই ফেরত পাঠিয়েছে আদালত। ধৃতের ৩ নভেম্বর পর্যন্ত পুলিশ হেফাজত বহাল রয়েছে। সেই তদন্তকারী অফিসারকেও আদালত এই ভুলের জন্য সতর্ক করেছে।
In a stinging indictment of Birbhum police, a Suri court on Friday directed SP Aloke Rajuria to suspend investigating officer Dhrubajyoti Dutta, relieve Parui OC Kartik Mohan Ghosh of duty , and hold a departmental inquiry into why police claimed they had arrested a `suspect' in the Makhra violence a second time when he was already in police custody .Chief judicial magistrate Indranil Chatterjee also urged the SP to think about the “kind of officers“ serving in his department and whether they are eligible for the job. Magistrate Chatterjee said he would draw the attention of Calcutta high court to the matter.
“The OC, Parui, has blindly signed the papers given to him by his officers... It is not possible for the court to ascertain whether he was sleeping or not... There remains a shadow of doubt. To remove these doubts the court recommends that the police superintendent initiate an in-depth inquiry ,“ magistrate Chatterjee said.The probe has to be conducted by someone ranked not below deputy SP .
During the hearing, the magistrate asked the Parui OC if he had submitted the report according to the court's directions on Thursday . When Ghosh said he had, assistant public prosecutor Kuntal Chatterjee told the magistrate: “I have read the report. It says the name was added as a mistake.But it does not explain why it is written that the second arrest was made from home.“ At this the magistrate asked, “Well, Mr APP , now at 10.30 am you are in the court. If somebody suddenly says that you are in Mumbai, how can it be possible?“ Chatterjee got the cue and replied, “Then somebody is lying, sir.“
On Thursday , police had produced Makhra violence suspects Biswanath Bagdi and Ali Jinna in magistrate Chatterjee's court. They were accused in case No. 152, lodged by police on the Makhra incident.To his surprise, the magistrate found that Jinna had already been arrested in case No. 155, filed by the father of slain BJP supporter Tousif Sk, on Tuesday . He had been produced in magistrate Chatterjee's court on Wednesday and remanded in five-day police custody . The magistrate summoned the SP, OC and investigating officer to explain the goof-up. Rajuria couldn't appear in court because of a personal bereavement and sent deputy SP Samit Chatterjee in his stead.
During the hearing, IO Dutta kept mumbling “sorry“ when the court sought answers. When the court asked the DSP what action had been taken, he said all steps will be taken in accordance with the court order. In the report, the IO and OC admitted there was a “mistake“.
Dutta tried to clarify that his real intention was to mention Jinna as “shown arrest“.The magistrate cornered him by asking why was Jinna then shown as arrested from home? As Dutta fumbled, the magistrate remarked, “The development is very unfortunate...not only for the accused but also for the court. And it happened solely due to callousness of police.“
Jinna's lawyer Malay Muk herjee was quick to seize on the goof-up, saying, “If the arrest is a mistake, he should be released from this case. He is an innocent college student and was arrested only because his father is active in politics.“
Meanwhile, six more suspects were arrested on Friday for the Makhra violence. Five of them are Trinamool Congress supporters and the sixth is a BJP man. This takes the number of arrests to 17. All six have been remanded in police custody till November 5.
Two more suspects were arrested on Friday for the attack on Parui cops in Chowmandalpur village, taking the number in custody to 10.

Suri (WB), Oct. 24 (PTI): The officer-in-charge of Parui Police Station in Birbhum district was injured
on Friday when bombs were hurled at a police team that had raided a village after it was informed that
bombs were being manufactured there.
OC Prosenjit Dutta has been admitted to the intensive care unit of Suri Hospital with splinter injuries.
Ananda Roy, the Additional Superintendent of Police, Birbhum district, said that a strong police contingent
led by the OC had raided Chakmondola village and seized bombs.
As the alleged bomb-makers escaped soon after the police team arrived, some people threw
bombs and brickbats at the police team, injuring the OC and three other policemen.
The police are searching the area. No arrest had been made yet.
The OC told reporters that the police team went to the village on being tipped off and that the villagers
threw the bombs.
”We had information and went there to seize bombs and we recovered some. The raid was continuing.
Bombs were hurled at us,” he said.
The officer in charge of the Parui police station, Prasenjit Dutta, and two more policemen were injured
in the mob attack in Birbhum.
BIRBHUM: A police officer was wounded when he and his team were attacked with bombs, bricks and sticks at a village in West Bengal's Birbhum district today. The police team had gone to the village this afternoon on a tip off that bombs were being made or stocked in the village.
The tip off did hold true at Sottor village where the police found at least 200 bombs stored in 14 drums at a disused health centre. But when they went to the adjoining Chowmandal village to search a poultry farm, they were attacked by the villagers.
The OC (officer in charge) of the Parui police station, Prasenjit Dutta, and two more policemen were injured in the mob attack. The OC has been admitted to a hospital at district headquarter Siuri with splinter injuries. A large police force rushed to the area and raided several houses in Chowmandal but did not find any bombs. 14 people have been detained for the attack on the police.
The political affiliation of those detained is not known but the incident has acquired political overtones. The CPM and the BJP are blaming the ruling Trinamool Congress of stashing the bombs. The Trinamool in turn is blaming it on the BJP.
The CPM and the BJP are pointing to a public statement by TMC's Birbhum district chief Anubrata Mondal urging his supporters to "bomb the police". Trinamool sources, however, claim that the BJP was trying to "capture" some villages in Birbhum and were stocking bombs for the turf war.
BJP's Rahul Sinha said, "The Trinamool is passing the buck. They attacked the police and are blaming us. But it is they who have been terrorising BJP supporters in the districts."
Trinamool MP Abhishek Banerjee issued a statement saying, "BJP is quick to rush to conclusions and preaching from Delhi. Birbhum incident is being investigated. Law will take its own course. Culprits will not be spared."
Trinamool's Anubrata Mondal has said, "Asking people to bomb the police was the biggest mistake of my life." **************

West Bengal government on Sunday said a large amount of bomb-making material and 'incriminating' documents were seized from the blast site at Khagragarh in Burdwan district which claimed two lives on October two and that a high-level composite task force has been formed to investigate the matter. Addressing a press conference, state Home Secretary Basudeb Banerjee said that the state was also in touch with central agencies including NIA in this regard.
"A large number of chemicals have been used in bomb-making and much of these have been seized. Recovery has also been made of a large quantity of literature both printed as well as downloaded from the internet which basically relate to ways and means of making bombs and explosive devices," Banerjee said. Ruling out allegations of the state not cooperating with central agencies, he said a section of media had reported that NIA had said that state agencies were not cooperating with them. "I would like to deny this. Senior officials of both sides are in touch, it is a far serious matter between the Centre and the state," he said. "Certain media reports said that posters relating to al- Qaeda were found. No such posters have been found so far. Investigation is on," the Home Secretary said.
He, however, denied that RDX was found at the blast site as reported in a section of media. "A Central Forensic Science Laboratory (CFSL) team led by assistant director has since visited the place of occurrence on the very next day and they have inspected the site," he said. "CID has taken over the investigation and the DGP has since formed a composite task force with top officials from CID, district police, IB and Kolkata Police under the leadership of DIG CID," Banerjee said.
"The accused persons before the police arrived tried to destroy some materials by burning but a large number of incriminating documents, telephones etc have been recovered," he said. "Investigation is continuing to see whether it has further ramification or not," he added. Banerjee said that two persons have been arrested so far in connection with the case.These are Gulsana Bibi, wife of Shakil and Alima Bibi, wife of Abdul Halim. "They were produced before a court and have been given nine days' police custody," he said.

Kolkata: Four days after a major blast at a Trinamool Congress leader’s house in Burdwan district of West Bengal, where three suspected terrorists were killed on October 2, the state government has ruled out the possibility of the involvement of Al Qaida.
While state Home Secretary Basudeb Banerjee refused to divulge details about the outfit that the investigation team was suspecting, he has ruled out the possibility of the international terror group.
“Certain media reports said that posters relating to Al Qaida were found. No such posters have been found so far. Investigation is on,” the Home Secretary said. He also denied reports of non-cooperation by the state police with the national agencies and that no RDX was found at the blast site as reported in a section of media.
“I would like to deny this, senior officials of both sides are in touch, it is a far more serious matter between the Centre and the state,” he said.
“A Central Forensic Science Laboratory (CFSL) team led by assistant director has since visited the place of occurrence the very next day and they have inspected the site. Criminal Investigation Department (CID) has taken over the investigation and the DG Police has since formed a composite task force with top officials from CID, district police, Intelligence Bureau and Kolkata Police under the leadership of DIG CID,” Banerjee said.
Investigators have so far arrested three people in connection with the blast. Hafez Mollah alias Hasan, who was detained by the CID from his house on Sunday, was formally arrested on Monday, DIG (Operations), CID Dilip Adak said.
Two other women — Rajira Bibi alias Rumi from Nadia and Amina Bibi from Murshidabad — were arrested on Sunday in connection with the blast in which involvement of terror outfits like Lashkar-e-Tayyiba and Harkat-ul-Jihad-al-Islami is being suspected. The police are on the lookout for a man named Abul Kalam, to whom several phone calls were made immediately after the blast.
Sources say that powerful grenades, chemicals used in making explosives, a book on how to trigger explosions, some jihadi literature, a video on jihadi training and maps of important locations in Kolkata were seized by the CID team from the house. A large number of watch dials, SIM cards and other tools required to make improvised explosive devices were also seized from the house.
“The group was certainly making powerful bombs and was trying to blast them during the Durga Puja and Eid festivities, the two biggest festivals in the state, to disturb the communal harmony. However, the bombs were triggered while being made, killing two people instantly and another later at the district hospital,” said a police official.
The state government is being blamed not only lack for police intelligence, as the suspected had rented the house a few months back, but also due to lack of preparedness against such evil forces.
“The state police is completely unprepared to handle any such forces. Not only lack of intelligence which is critical in fighting such forces, the police is not trained to investigate the issues properly, where critical evidence was lost due to manhandling of the blast site,” said an officer of the state home department.
KOLKATA: The ruling Trinamool Congress in West Bengal has come under fire for alleged involvement in anti-national activities after an explosion killed two people in Burdwan on Thursday. The CPM and the BJP say the police destroyed evidence before the National Investigation Team (NIA) could reach the spot.
The building where the blast took place - located in Khagragarh area - is owned by a former state government employee who is allegedly a Trinamool supporter. Some Trinamool flags were found stacked in one of the rooms on the ground floor. At one time, the Trinamool had also allegedly used a room in the house as an office.
"A bomb blast took place inside the home of a TMC leader. In that house people of Indian Mujahideen were living. Some substance exploded and after which it was told that NIA should be informed. But NIA was informed 24 hours later. The material which could have been used as the evidence was destroyed in river... Mamata Banerjee should tell that if that home belongs to a TMC leader or not? Why did your SP of Burdwan destroy the evidence?" BJP leader Siddharth Nath Singh asked in Delhi.
CPM leader Sitaram Yechuri said, "The track record of state police in recent years does not augur well. Central government should interfere and act against the guilty."
The Trinamool, denying any links with the blast, claimed the BJP and CPM were conspiring to disturb peace in the state at a sensitive time - the end of the Durga Pujas and the eve of Eid.
"The comments by Biman Bose and the BJP are totally insensitive. The timing too is devious, especially at this juncture when Durga idols are still being immersed and the holy festival of Eid is to be held tomorrow," said Mukul Roy, Trinamool General Secretary.
The owner of the house where the blast occurred has been detained for questioning. Two women who lived as tenants there have been arrested.
Meanwhile, in Kolkata this evening, principal secretary, home, Basudeb Banerjee, denied any RDX or Al Qaeda posters had been found at the blast site. He also denied reports about lack of cooperation between the state police and central agencies investigating the incident.
Denying the allegation that the Trinamool Congress had links with the blast at Khagragarh in Bardhaman (Burdwan) district last Thursday, party general secretary Mukul Roy said the investigation was following normal procedure. He lauded the police administration for a “proper and fast” investigation.
Two persons were killed and another was injured in the blast.
Earlier in the day, the Bharatiya Janata Party and the Communist Party of India (Marxist) charged the Trinamool with having links with the blast.
“How do we know if the BJP and the CPI(M) are not linked with the blast and is trying to create unrest in the State?” Mr. Roy asked. He alleged that the Opposition was making “irresponsible comments.” “Biman Bose, CPI(M) State secretary, and the BJP are trying to disturb the peace and thus denigrate the government ... by making irresponsible statements.”
Denying the allegation that the house where the blast occurred had a Trinamool office, Mr. Roy said it must be “substantiated.”
“Local people would have known, if the house had the Trinamool office. Electronic media would have filmed ... do you have any footage that establishes that the house had (party) office,” he asked.
“One may cook any allegation but it has to be substantiated. In the Babri Masjid demolition case, many allegations were made against BJP leaders, but nothing materialised,” he said.
BJP charge
BJP leader Siddharth Nath Singh said at a press conference in Delhi that Bangladeshi infiltrators had rented the housed. Mr. Singh said: “The local police destroyed all evidence” to “cover up the incident” so that the Trinamool remained “above suspicion.”
“The local police collected samples and destroyed it within seven hours. The evidence included mobile phones, ID, IM proofs and al-Qaeda’s jihadi literature. Since the Central forces were informed late, they could not reach on time. All these raise questions on the Mamata Banerjee government,” Mr. Singh said.
Central agency sources told The Hindu that their officials were not allowed entry into the house even two days after the explosion. However, West Bengal Home Secretary Basudeb Banerjee denied “non-cooperation” with the Central agencies.
West Bengal Left Front committee chairperson Biman Basu quoted newspaper reports to say pamphlets of “banned Muslim fundamentalist organisation” were recovered from the house. Later, the CPI(M) said in a statement that the Trinamool office was located in the house. “Soon after the explosion, the signboard of the Trinamool Congress was removed ... local people alleged that that the police tried to block the probe initially,” Mr. Bose said.
